Terms of Service

1. Acceptance of Terms

By accessing or using the service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the service.

2. Eligibility and Accounts

You must be at least 16 years old to use the service. You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

3. Use of the Service

You may use the service only in compliance with applicable laws and these Terms. You may not misuse the platform, interfere with its operation, attempt unauthorized access, reverse engineer restricted components, or use the service to create unlawful, infringing, harmful, or deceptive content.

4. Your Content

You retain ownership of the content you submit to the service. You grant us a limited license to host, process, transmit, and display that content solely as needed to operate, secure, and improve the service.

You represent that you have all rights, permissions, and legal authority necessary to submit your content and request AI-generated outputs from it.

5. AI-Generated Outputs

Subject to your compliance with these Terms, you own the AI-generated outputs created through your use of the service. You are free to use, modify, and distribute these outputs for any lawful purpose.

However, AI-generated outputs may be incomplete, inaccurate, or unsuitable for your intended purpose. You are responsible for reviewing outputs before using, sharing, publishing, or relying on them. We do not guarantee that outputs will be unique, error-free, or free from third-party claims.

6. Plans, Billing, and Payments

Paid features require a subscription. All payments are processed securely through Stripe. By subscribing, you authorize recurring charges at the then-current rate until you cancel.

• Auto-renewal: Subscriptions automatically renew at the end of each billing cycle unless you cancel before the renewal date.
• Cancellation: You can cancel your subscription at any time through your account settings or the Stripe billing portal. Cancellation takes effect at the end of the current billing period, and you will retain access until then.
• Price changes: We will notify you at least 30 days in advance of any price increases. The new price will apply to your next billing cycle after the notice period.
• Refunds: Fees are generally non-refundable. However, if you experience a significant service issue, contact us and we will review your case on an individual basis.

7. Suspension and Termination

We may suspend or terminate access to the service if we believe you violated these Terms, created legal or security risk, or if continued access would harm the platform, other users, or third parties.

You may delete your account at any time. Upon termination or account deletion, we will retain your data for up to 30 days to allow for recovery, after which your personal data, uploaded files, and conversation history will be permanently deleted (except where retention is required by law, such as billing records).

8. Intellectual Property

The service, including its software, branding, design, and related materials, is owned by us or our licensors and protected by applicable intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, lease, or create derivative works from the service itself.

9. Disclaimers

The service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

10. Limitation of Liability

To the fullest extent permitted by law, our total aggregate liability to you for all claims arising from or related to your use of the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim. We will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunities.

11. Indemnification

You agree to defend, indemnify, and hold us harmless from claims, liabilities, damages, losses, and expenses arising from your content, your use of the service, or your violation of these Terms or applicable law.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the service shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

13. Changes to the Service or Terms

We may modify the service or these Terms at any time. When we make material changes, we will notify you by updating the date at the top of this page and, where appropriate, by email. Continued use of the service after updated Terms become effective constitutes acceptance of the revised Terms.
